Substantive and procedural provisions in the publication of criminal judgments: A comparative study

Abstract

This research explores the publication of criminal judgments as a legislative tool designed to achieve general deterrence and enhance judicial transparency. By examining various legal systems, the study defines the legal nature of publication—assessing whether it functions as a primary, secondary, or supplementary penalty—particularly in crimes involving corruption or embezzlement of public funds. Substantively, it investigates the legal basis, mandatory versus optional application, and the necessary balance between public information and the convicted individual's right to privacy and reputation. Procedurally, the research details implementation mechanisms, such as media platforms and timing, alongside legal safeguards like the right to appeal. Through a comparative lens, it highlights modern trends toward stricter regulatory controls to protect fundamental freedoms. The study concludes that while publishing judgments effectively combats crime and builds public trust, it must be governed by precise legal constraints. This ensures a vital equilibrium between social interests and fair trial guarantees, ultimately advocating for the alignment of national laws with international human rights standards to prevent excessive infringement on individual rights.
