Abstract

The ministerial program constitutes a fundamental pillar in parliamentary systems, as its role is not limited to being a political agenda through which the government declares its general orientations; rather, it represents a constitutional and legal commitment directly linked to the granting of confidence to the government and the continuity of its mandate. In the Iraqi constitutional system, the ministerial program acquires particular importance, as it is a mandatory requirement for the formation of the government under the 2005 Constitution. This confers upon it a binding character and removes it from the realm of a merely formal document or a temporary political speech. However, practical reality reveals a substantial constitutional problem manifested in the weak commitment of successive governments to implementing the contents of the ministerial program, whether wholly or partially, in the absence of explicit constitutional provisions that determine the legal sanctions resulting from such non-compliance. The reliance solely on traditional political oversight mechanisms—such as parliamentary questioning and the withdrawal of confidence—has led to a weakening of the effectiveness of legislative oversight and a reduction in the practical impact of the principle of constitutional supremacy and the balance between powers.
