Public-Private Partnerships and Their Impact on the Budget According to Instruction No. 1 of 2024

Abstract

One of the most prominent challenges facing the implementation of public-private partnerships (PPPs) in Iraq is the financial risks, legal complexities, and weak regulatory environment, and the impact of these factors on the financial sustainability of the general budget. Therefore, this study addresses the legal framework for PPPs by clarifying their concept, objectives, and contracting mechanisms between the two sectors. It also examines their financial impact on the general budget in terms of reducing capital expenditures and increasing government revenues, as well as their effect on the Iraqi general budget in light of Instruction No. (1) of 2024. Through this, the study aims to demonstrate the contribution of PPPs to improving infrastructure, attracting investments, and enhancing the efficiency of public services, provided there is a clear legal framework and effective oversight mechanisms that ensure transparency and sound management of public resources. This cannot be achieved without creating a suitable legislative and institutional environment and supporting transparency and accountability to guarantee the success of partnership projects and the achievement of sustainable development goals.
