Criminal protection of the child in contemporary criminal law

Abstract

The research addresses the status of children as victims and delinquents in international and national law by analyzing the international legal framework represented by the Convention on the Rights of the Child and related conventions، and comparing it with Iraqi national legislation. The research demonstrates that international law has paid great attention to children as victims deserving of protection from exploitation، violence، armed conflicts، and wars. It also emphasizes the need to take corrective measures when children commit delinquency Exploitation، violence، armed conflicts and wars، as he emphasized the need to take corrective measures when he deviates. In contrast، national legislation، despite including important texts، is still affected by a punitive nature more than a reformative one and suffers from shortcomings in confronting emerging crimes and ensuring a fair trial. The researcher concluded that Achieving effective child protection requires harmonizing national legislation with international standards، expanding the scope of reform alternatives، strengthening procedural safeguards، and adopting social and economic policies that reduce the causes of delinquency.
