Electronic Banking Transformation in Light of Its Legal Nature and Application Challenges

Abstract

Electronic transfer represents one of the effective tools for the rapid and sophisticated circulation of funds. However، significant jurisprudential controversy has arisen regarding its legal nature and the legal rules applicable to it. Furthermore، several obstacles hinder its practical application. In this research، we have attempted to clarify the concept of electronic bank transfer and its legal nature we also, addresses the obstacles encountered during this process. We concluded that the transfer is a contract of a distinct and independent nature that arises between the bank and the client, and involves the beneficiary as well The parties may choose the applicable law for this procedure, also establishing jurisdiction, issues of evidence, and compensation. Accordingly، the researcher proposes the necessity of establishing comprehensive and clear legislation for electronic bank transfers that defines the nature and provisions of this contract، unifying legal texts related to banking operations into a single law to provide judicial stability and enhancing electronic protection and encouraging its use.
