Legal Protection Of Electronic Payment Methods In Commercial Transactions

Abstract

The legal framework governing electronic payment methods in commercial transactions has become increasingly significant in light of the rapid expansion of the digital economy and the growing reliance of consumers and business entities on electronic payment systems as the primary means of executing commercial transactions. This study examines the appropriate legal characterization of electronic payment methods within the framework of commercial activities. The study further analyzes the civil liability of both banks and electronic payment service providers, with particular emphasis on the allocation of risks among the parties involved, especially in cases of electronic fraud and technical failures. It also examines the legislative, criminal, and regulatory safeguards governing electronic payment transactions in Iraq and assesses their effectiveness through a concise comparative analysis of selected advanced foreign legal systems in order to identify the strengths and shortcomings of the Iraqi legal framework. Furthermore, the study highlights the role of arbitration as an effective mechanism for resolving disputes arising from electronic payment transactions, owing to the flexibility, efficiency, speed, and confidentiality it offers, all of which are particularly suited to the nature of digital commercial activities.
