The Illicit Use of Deepfake Technology on Social Media Platforms

Abstract

The unlawful use of deepfake technology on social media platforms has emerged as one of the most significant contemporary challenges due to its present and future risks، which threaten societal security، public peace، as well as the economic and political security of states. Accordingly، this study examines this phenomenon and its associated risks by clarifying the concept of deepfake technology and tracing its emergence. It further explores the various forms through which this technology may be misused، including defamation، infringement of individual freedom، manipulation of public opinion، threats to societal security، and violations of the right to privacy. The study also examines the legislative responses to the unlawful use of deepfake technology through an analytical assessment of the legal provisions relevant to this issue and evaluates their adequacy in limiting the increasing spread of this phenomenon at the national، comparative، and international levels. The study concludes that the Iraqi legislature has not yet fully kept pace with the rapid and continuous technological developments، resulting in a degree of legislative inadequacy. Consequently، there is a pressing need to enact more specialized and flexible legislation capable of effectively addressing the unlawful use of deepfake technology. Furthermore، the study emphasizes the importance of strengthening international cooperation to ensure the effective protection of individuals and society against the risks arising from the misuse of deepfake technology.
