Legal regulation of water uses of international rivers in light of the rules of public international law

Abstract

disputes over international rivers have become a global challenge, leading to growing conflicts between riparian states. This is due to the lack of a unified framework governing the regulation of international rivers under the rules of public international law. This stems from differing interpretations by states of the legal definition of international rivers, the analysis of the legal basis for their exploitation, and the fundamental principles governing them, most notably the principles of equitable and reasonable utilization and the principle of not causing harm. Therefore, this study sought to clarify the foundations and rules of public international law, particularly international conventions and customary international law, related to regulating the uses of international rivers. It focused on the most significant developments introduced by the 1997 United Nations Convention on the Law of the Non-Navigational Uses of International Watercourses, as well as the challenges facing the practical application of these rules. These challenges include conflicting national interests and weak enforcement and dispute resolution mechanisms, which in some cases lead to the escalation of water disputes. Consequently, there is a need to strengthen implementation mechanisms to ensure the equitable and sustainable use of shared water resources (an important point requiring further explanation). Achieving effective legal regulation depends primarily on international cooperation and a serious commitment from riparian states, thereby striking a balance between national sovereignty and the requirements of common interest.
