DNA fingerprinting as a means of proving lineage: A study in light of the position of Iraqi legislation and judiciary

Abstract

Genetic fingerprinting is one of the most accurate contemporary scientific methods, as it relies on the analysis of DNA, which distinguishes each person from another, giving it a high ability to detect biological links, especially the link of lineage. However, the introduction of this method in the field of proving lineage has raised deep jurisprudential and legal problems, especially regarding its validity, the limits of its use, and its compatibility with Sharia rulings and applicable legal texts. In this context, the position of Iraqi law stands out, especially the Personal Status Law, which did not explicitly stipulate genetic fingerprinting as an independent means of proving lineage, thus opening the door for judicial interpretation and jurisprudential reasoning in dealing with it.
